Lawsuit: Arlington Heights cop’s negligence led to rape of intoxicated girl

An Arlington Heights police officer responding to an underage drinking complaint let a 20-year-old felon and two drunk teenage boys go without question – despite the fact that they were toting around a possibly unconscious underage girl. Minutes later the three males were caught raping the girl in a laundry room by officers from neighboring Mount Prospect police.

And it gets worse.

The allegedly negligent police officer is a former Chicago cop who ran over two kids with his squad car in 2004killing one and permanently injuring another — after throwing on his siren and driving the wrong way in traffic to escape a traffic jam. The officer then lied to his bosses, saying he had been in hot pursuit of a gunman at the time.

These are the claims of a lawsuit filed Tuesday in Cook County Circuit Court.

The girl who says she was raped – referred to throughout the lawsuit only as “Jane Doe” – is suing the Village of Arlington Heights and police officer Mark Del Boccio for negligence, infliction of emotional distress and other charges stemming from the May 2009 incident at the Mansions of Mountshire Apartment Complex, which sits on the border of Arlington Heights and Mount Prospect.
